3. Use of Website

You agree not to:

4. Client Responsibilities

Clients engaging our architectural services agree to:

  • Provide necessary project-related documents, including title deeds, plans, and constraints.
  • Allow reasonable time for service execution and make themselves available for discussions.
  • Review and approve plans to ensure their requirements are met.
  • Appoint necessary consultants for specialized services.
  • Pay invoices within seven (7) days of receipt.
  • Not commence building work without approved plans. If work is done without approval, the owner assumes full responsibility for any costs, changes, or demolitions required for compliance.

5. B-Plan Pro’s Responsibilities

B-Plan Pro will:

  • Act within the scope of authority provided by the client.
  • Exercise due care, skill, and diligence in providing architectural services.
  • Comply with building regulations and industry standards.
  • Notify the client of potential risks or additional costs.
  • Maintain professional indemnity insurance where applicable.

B-Plan Pro is not responsible for:

  • The financial viability of the project.
  • The performance of third-party consultants.
  • Delays outside our control.
  • Obtaining an occupancy certificate unless specifically agreed upon.

6. Payment Terms

  • Accepted payment methods: EFT, direct deposit, and cash.
  • Payments must be made to B-Plan Pro’s designated bank account.
  • Work may be suspended if payment is overdue beyond seven (7) days.
  • Interest of 2% will apply to invoices unpaid for more than thirty (30) days.
  • Any invoice disputes must be raised within fourteen (14) days of issuance.

7. Budget and Cost Estimates

  • Project budgets are based on estimates and subject to revisions.
  • B-Plan Pro will strive to work within the agreed budget but does not guarantee final costs.
  • Revisions or amendments may incur additional charges.

8. Dispute Resolution

  • Any disputes will first be referred to mediation.
  • Mediator fees will be shared equally by both parties.
  • If mediation fails, disputes will proceed to arbitration.
  • Arbitration decisions will be binding on both parties.

9. Termination of Services

  • Either party may terminate or postpone services with written notice.
  • All work completed before termination must be paid for.
  • A termination fee of 10% of the total contract value may apply if the termination is not due to B-Plan Pro’s fault.
  • In case of a material breach, a 14-day notice period will be given before termination.

10. Special Conditions

  • Clients acknowledge and accept all conditions related to their property assessment and project requirements.
  • Any verbal or electronic agreements are considered binding alongside these terms.

11. Amendments to Terms

B-Plan Pro reserves the right to modify these Terms at any time. Continued use of our website and services after changes signifies acceptance of the revised terms.
